The Court of Appeal has found that HM Revenue and Customs do owe a duty of care to a taxpayer if it makes mistakes and as a consequence, the taxpayer can sue HMRC for damages.
How do I complain to HMRC?
To make a complaint, you should write to or telephone the HMRC office that you have been dealing with. Contact details are available on GOV.UK, with links to online forms. You can use these to make a complaint if you have set up an online tax account, rather than sending a letter through the post.
Does HMRC pay compensation?
‘If we handle your complaint badly or take an unreasonable time to deal with it, we may pay you compensation, on top of any reasonable costs, to reflect this. The company are trying to cover their backs with the warning they don’t want you claiming it’s an unfare redundacy. If HMRC say it is contrived and tax/NI the £30k then that helps you with a case. Remember if you get hit for tax/NI good chance they get hit for NI as well.
