Does my employer have to give me a contract?
You might not have anything in writing, but a contract still exists. This is because your agreement to work for your employer and your employer’s agreement to pay you for your work forms a contract. Your employer must give you a written statement the day you start work.
What happens if you do not have a contract of employment?
If the employer fails to provide the employee with a contract, they could land up in jail (section 93 of the BCEA) or be liable for a hefty fine (schedule 2 of the BCEA). If there is no contract, or if the employee has never been informed, then he/she has the right to conclude that it does not exist.
How long is a month to month contract?

If he’s not, then at least you’ll know where you stand, and you can make a decision about what to do next. It is really a drag to be in a “marking time” sort of job.
